A 46-year-old motorist has been found guilty of causing serious injury to a motorcyclist when the car she was driving pulled out in front of him. Following a three-day trial at Nottingham Crown Court, a jury took less than two hours to unanimously convict Agnieska Lason of the crime which left victim James Riley with multiple fractures. He was hospitalised for 15 days when the Toyota Yaris the defendant was driving in Ilkeston pulled out a junction – causing him to “take evasive action” and collide with her vehicle. Lason, of Julian Close, Ilkeston, had denied the charge but, after hearing all of the evidence, they found her guilty of the charge she faced. She cried in the dock as the verdict was delivered by the forewoman. Handing her bail and adjourning sentence to June 17, Judge Rafferty said: “I will need a pre-sentence report. “This is not the most serious of this type of offence but the injuries were.” Prosecutor Gareth Gimson, opening the trial, said the incident happened at the junction of Westwick Street and Greenwood Avenue, which becomes Roberts Street, in Ilkeston, on February 15, 2023. He said the defendant pulled out of Westwick Avenue when Mr Riley’s 125cc bike collided with it. The prosecutor said: “The Crown’s case is that Miss Lason was driving her motor vehicle on Westwick and, as she met the T-junction, she turned right. “The complainant James Riley was riding his motorcycle along Greenwood and that is where the coming together occurred. “The crown says there are things she did that were wrong and caused him to fall off his motorcycle and led to him suffering serious injuries. “It is not going to be disputed that Miss Lason was the driver of that vehicle. “He was there to be seen, he had gone out of his way to make himself as visible as he could do. “He was wearing a jacket and trousers with reflective stripes and a backpack with reflective stripes. “It was a straight road and he had right of way, he said he was riding at 30mph.” Mr Gimson said as Mr Riley approached the junction he saw Lason pull out and put his bike into an emergency brake. He said: “In his own words, he lost the front end and ultimately collided with the back of her car . “In interview she said she did not see him and that’s what she told Mr Riley when she got out of her car.” The prosecutor said: “We don’t seek to say there is any malice, she did not intend to hurt anyone that day but she was not driving with due care and attention, we say. “She will say ‘what could I have done?’ and that this is all Mr Riley’s mistake, he overreacted and hit the brakes hard. “The crown’s case is that is manifestly nonsense.” Giving evidence, Mr Riley said he was riding to work when he saw Lason pull out of the junction. He said: “I began to brake and she continued on her path which crossed the roadway. “I had to take evasive action and slammed on the front brake and I ended up skidding into the defendant’s vehicle. “Miss Lason got out of the vehicle and almost immediately said ‘I am sorry I did not see you’.”
